These terms govern your use of EYAPAY. By creating an account you agree to them. Please read them — particularly the sections on fees, payouts and prohibited use.
1. What EYAPAY is
EYAPAY is a software service that lets you request and receive payments from your customers. We provide the interface, the payment request, the receipt and the record keeping. Card processing itself is performed by our payment processor, Whop, and their card network partners.
EYAPAY is not a bank. We do not take deposits, we do not pay interest, and funds held in your EYAPAY balance are not insured as bank deposits.
2. Eligibility
You must be at least 18 years old and legally able to enter contracts. You must be operating a genuine business or trade, and the information you give us about that business must be accurate and kept up to date.
3. Fees
We charge 10% of each successful transaction. The fee is calculated on the gross amount and deducted before the remainder is credited to your balance. There is no monthly subscription, setup fee or cancellation fee.
Withdrawals to a US bank account are free. Withdrawals pushed to a debit card carry a network fee of 1.5% plus $0.25, which is shown to you before you confirm the withdrawal.
Fees may change with 30 days notice given by email and in the dashboard.
4. Your balance and payouts
Your available balance is the sum of settled payments less our fee and less any withdrawals already requested or paid. You may request a withdrawal at any time up to your available balance.
We may delay or hold a payout while we investigate unusual activity, a dispute, or a suspected breach of these terms. Where we do so we will tell you why unless prevented by law.
5. Transaction limits and verification
New accounts may process up to $500 per rolling seven day period. Submitting a verification request from your settings removes this limit. We may impose or reinstate limits on any account where we identify elevated risk.
6. Prohibited use
You may not use EYAPAY to take payment for, among other things:
- anything illegal where you or your customer is located
- weapons, controlled substances, or counterfeit goods
- adult services, gambling, or debt collection
- money transmission, currency exchange, or the purchase of crypto assets
- charging your own card, or any other attempt to obtain cash from a card
- goods or services you cannot actually supply
Breach of this section may result in immediate suspension and forfeiture of pending payouts.
7. Disputes and chargebacks
If a customer disputes a payment with their card issuer, the disputed amount may be reversed from your balance, including our fee. You are responsible for providing evidence of the sale. Keeping your receipts and descriptions accurate is the best protection you have.
8. Your responsibilities
Keep your password private and your device secure. You are responsible for activity taken through your account. Tell us immediately if you believe your account has been accessed by someone else.
You are responsible for your own tax obligations, including reporting income received through EYAPAY. We do not withhold tax on your behalf.
9. Availability
We aim to keep EYAPAY running continuously but we do not guarantee uninterrupted availability. We are not liable for sales you could not take during an outage, whether ours or our processor's.
10. Limitation of liability
To the fullest extent permitted by law, our total liability to you for any claim arising out of these terms is limited to the total fees you paid us in the three months before the claim arose. We are not liable for lost profits or indirect losses.
11. Ending the agreement
You may close your account at any time from settings. We may suspend or close your account for breach of these terms, for legal reasons, or on 30 days notice. On closure we will pay out any remaining balance you are entitled to, less amounts we are permitted to withhold.
12. Changes and contact
We may update these terms. Material changes will be notified at least 30 days in advance. Continuing to use EYAPAY after a change takes effect means you accept it.
